Malpractice descriptionIn Romania, the concept of malpractice was introduced by the Law no. 95/2006 on civil liability of medical staff, being defined as that professional error, committed in the exercise of medical or medical-pharmaceutical act, generating harm to the patient, involving the civil liability of the medical staff and the provider of medical, sanitary and pharmaceutical products and services. Therefore, in case of a situation regarding the occurrence of a medical error, the activity of the lawyer will be focused on whether or not the conditions regarding the tortious civil liability need to be met.

Insolvency law descriptionThe activity of companies is and will remain influenced by the economic environment, by its unpredictable changes, by micro and macro-environmental factors, which can cause significant imbalances in fulfilling the payment obligations assumed. Therefore, the Romanian legislator created the legal framework for resolving these situations, providing the procedure by which creditors or even the debtor itself to resort to addressing a request to the courts, for purposes of ordering the entry under the Law no. 85/2014 on insolvency prevention and insolvency proceedings, in order to cover the liability, either by reorganization or by liquidating the debtor.
